For the purpose of these terms and conditions the hirer of the equipment shall be referred to as the “Customer”

The owner and supplier of the equipment shall be referred to as “The Staple Shed”.  

Equipment means all items that are hired and collected by the customer or delivered by The Staple Shed to the customer whether or not the items have been paid for.       

On commencement of hire without the customer’s written confirmation to such action it shall be deemed that the customer agrees to and accepts these terms and conditions of hire listed.

BOND

The Staple Shed reserves the right to request a security bond to cover any equipment. The bond and amount will be determined by individual booking requirements. Any damaged, missing, very unclean items will be charged at full replacement cost and this will then be deducted from the bond amount. Should this amount exceed the total bond amount on hold, the customer will be responsible to pay any balance owing. Security bond refunds may take up to 48 hours to process following an event.

CANCELLATION POLICY

The Staple Shed is aware that things out of our control may occur, and it is required that the customer notifies The Staple Shed in writing as soon as made aware.

Due to intemperate weather conditions, The Staple Shed will endeavour to assist with rebooking or scheduling the customers event at a later date.

In event or circumstance beyond the reasonable control of a party, including, but not limited to, acts of God, war, rain, hail, wind, fire, explosion, pandemics, civil disobedience, and legislation not in force at the date of this agreement, The Staple Shed will not be liable to continue with the hire arrangement if considered too dangerous or unsafe. Refund will be in full processed within 48 hours.

DAMAGE, LOST, STOLEN OR UNCLEAN EQUIPMENT

Upon delivery of the equipment and until the return of the equipment to The Staple Shed’s premises the customer has full responsibility of all equipment hired. The customer will pay full replacement cost of any equipment badly damaged, lost or stolen. The customer will pay any repairing costs to damaged equipment. Any damaged equipment will be decided by The Staple Shed if it can be repaired or require replacement. Burns, holes, tears, water damage or other similar damage to equipment shall be replaced at full cost to the customer.

All goods are to be returned in a clean and dry condition. Any equipment returned unclean by the customer to The Staple Shed, the customer shall pay The Staple Shed the full cost of returning the equipment to a clean condition. The customer shall protect the equipment from the elements during the time of hire. In poor weather conditions storage of the equipment may be necessary and is the responsibility of the customer to see that the equipment is stored safely. Any equipment damaged from weather is the full responsibility of the customer and shall be paid at full replacement cost to The Staple Shed.

The Staple Shed’s equipment shall be delivered to the customer in a clean and well maintained condition. It is the customer’s responsibility to notify The Staple Shed should the equipment not be in a satisfactory condition within one (1) hour of receiving the equipment. Otherwise any damage or uncleanliness of equipment shall be deemed the customer’s accountability. The hirer must not tamper or in any way interfere with, or repair or attempt to repair the Equipment

DELIVERY, COLLECTION AND SETUP

This fee will vary depending upon distance travelled from The Staple Shed’s premises. The customer will be advised of the fee once all equipment has been decided upon. This fee may be subject to change should the customer then decide on change of venue which may alter the distance travelled from The Staple Shed’s premises. Unless a handling and maintenance fee has been charged and agreed upon by The Staple Shed, the hire company is not responsible for the setup of equipment. The customer is responsible for having someone available to take delivery of the equipment at the nominated date. If the customer fails to be there at that time, an additional delivery fee will be charged to re-deliver the equipment at another time. All goods are to remain at the customer’s address as advised on the booking unless written consent is given by The Staple Shed.

CUSTOMER PICK-UP

The Staple Shed offers pick up arrangement of hire items from our shed in Moore Creek, NSW.

Customer pick-ups are available at a pre arranged time and will be discussed at time of booking.

Customers are to ensure ropes, protective blankets and or tarps are brought with them to ensure the safe collection of hire items and each customer must have appropriate comprehensive vehicle insurance. It is required that each customer is to have an unencumbered drivers license and extensive towing/handling history.

DISCLAIMER

The Staple Shed shall in no way be held responsible or accountable for any injury, death or loss of income caused to the customer, any third parties or properties due to the hire of equipment or provided services by The Staple Shed. No warranty is given by The Staple Shed, nor is The Staple Shed liable for any damage or harm whatsoever in respect to the equipment except through the wrong doing of The Staple Shed. The customer is responsible for all loss and damage to the equipment. The customer is required to grant access to The Staple Shed and to their equipment when called upon to do so for repair and or examination, or in case of customer default, removal of goods and or equipment may apply.

NO SALE AND ACKNOWLEGEMENT OF OWNERSHIP

This is a hiring agreement only and does not constitute or give rise to any sale of the Equipment to the Customer, any hire purchase agreement or arrangement with the Customer or any leasing agreement that contains an option to purchase the Equipment. The relationship between the Owner and the Customer is limited to a relationship of owner and bailee in respect of the goods

The Customer acknowledges that The Staple Shed is the sole exclusive owner of the Equipment

Nothing in this Contract confers any option on the Customer to purchase the Equipment or any part of

SAFE OPERATION

All items for hire are a 2 person minimum move. Please ensure you have fit and healthy persons to assist with relocation of the hire items to ensure safety of the items and persons. Do not exceed the equipment’s weight or capacity limits. Items from The Staple Shed have a MAX 20kg weight limit per person. The Staple Shed ensures clean equipment using appropriate cleaning agents and methods and remove debris, spills, and stains promptly to prevent damage.
